Estate Planning FAQs
-
A Will is one of the most important documents you will ever sign. It is a legal document that expresses your wishes as to how your assets should be distributed after your death. A Will also appoints a legal representative to manage the estate assets until final distribution.
-
It is estimated that approximately 50% of Australians die without a valid Will. Having a valid Will in place provides certainty and peace of mind for both yourself and your loved ones. Ensuring that your Will reflects your current wishes will save your loved ones a lot of time, stress and money in the event of your death. It can also prevent your beneficiaries from being burdened with unnecessary distress or disputes.
-
If you die without a valid Will, you will be considered to have died "intestate". This means that a person entitled to your estate is required to make an application to the Supreme Court of Western Australia for a Grant of Letters of Administration. Your estate will thereafter be distributed according to a pre- determined formula set out in the Administration Act 1903, rather than according to your wishes.
-
Any person over the age of 18 years who is of sound mind can prepare their own Will. However, Wills are complex and important documents and it is therefore recommended to have a Will prepared by a professional. As part of the estate planning process, AMS & Co Legal will provide specialist estate planning advice and strategies tailored to your individual circumstances. AMS & Co Legal will ensure that your Will not only complies with all of the formal requirements, but it also reflects your current wishes and adequately provides for your loved ones.

An Enduring Power of Attorney (also known as an EPA) is a legal document that a person can make to give another person or persons, the legal authority to make financial and property decisions on their behalf, either immediately, or once they have lost the capacity to do so themselves.
-
An Enduring Power of Guardianship (also known as an EPG) is a legal document that a person can make to give another person or persons, the legal authority to make personal, lifestyle, treatment and medical decisions on their behalf in the event that they lose the capacity to make such decisions for themselves.
-
An Advance Health Directive (also known as an AHD or Living Will) allows a person to make decisions about the health care that they receive in the future.
